Terms of trade
1. General conditions
- These general conditions (hereinafter after “General Conditions”) define the legally binding relationship between the Seller and the Buyer in the CENTRUM SEDACÍCH SOUPRAV store, which are binding on both sides.
2. Purchase price and delivery of goods
- The purchase prices indicated on the web pages at www.centrum-sedacich-souprav.cz are valid at the moment of payment. The purchase price will be considered as paid when the full price is paid in cash in the Seller’s store. The invoice issued on the basis of the purchase contract between the Seller and the Buyer also serves also as a tax document. The Bill of Deliver serves also as a Warranty card and will be given to the Buyer by the delivery company when the merchandise is delivered. The Buyer may take possession of the merchandise only after it is fully paid.
- If the purchase price is paid the Buyer when he makes the purchase in the Seller’s store, and the Seller is for some reason unable to make delivery of the purchased merchandise, the Seller agrees to return the purchase price that has been paid to the Buyer without delay in a manner agreed to by the parties. The deadline for returning the purchase price depends on the method of returning the purchase price (bank transfer).
- The cost of delivery in the Karlovy Vary region is included in the purchase price.
- The cost of delivery outside of the Karlovy Vary region is not included in the purchase price and is charged to the Buyer at 10 CZK without V.A.T. for each kilometer, or part thereof, from the border of the Karlovy Vary region. The cost of delivery is paid to the delivery company.
- The price for transfering the goods is not included in the purchase price and is 100 CZK without V.A.T. for each floor the goods are moved. The cost of moving the goods is paid to the delivery company.
- The price of delivery outside of the Czech Republic is not included in the purchase price and will be agreed individually.
Payment Methods for in-store purchases
- Credit Card. In the store the Seller will issue an invoice where payment by credit card will be indicated. The Seller will also give the Buyer the product use and care instructions and will agree delivery with the Buyer and inform the delivery company. The delivery company will subsequently deliver the sofa, together with the Transfer Protocol which also serves as the Warranty card.
- Cash payments. In the store the Seller will issue an invoice where payment in cash will be indicated. The Seller will also give the Buyer the product use and care instructions and will agree delivery with the Buyer and inform the delivery company. The delivery company will subsequently deliver the sofa, together with the Transfer Protocol which also serves as the Warranty card.
- Combined payment. In the store the Seller will issue an invoice where a combined method of method of payment will be indicated. The Seller will also give the Buyer the product use and care instructions and will agree delivery with the Buyer and inform the delivery company. The delivery company will subsequently deliver the sofa, together with the Transfer Protocol which also serves as the Warranty card.
- Installment payments from GE Money Multiservis. The Buyer provides the Seller with his identity card (Občanský Průkaz) and a second identity document (driving license, passport, bank card, OK card, or gun permit), so that the Seller can check the Buyer’s identity. The Buyer selects the specific GE Money Multiservis product (selects how installment payments will be paid) and the Seller, with the Buyer’s assistance, completes the online loan application. The reply from the bank will come to the Seller within a minute. If the loan is approved, the Seller will complete a loan contract with the Buyer and print three (3) copies along with the Consent to process personal information. One copy is for the Buyer, one copy remains in the Store, and one copy is sent to GE. The Seller issues an original invoice where the method of payment is indicated - Installment payments from GE Money Multiservis. In case a down-payment is made, the amount of the down-payment is indicated in the column down-payments. The Seller will also give the Buyer the product use and care instructions and will agree exact delivery terms with the Buyer (approx. 7 days following purchase) and inform the delivery company. The delivery company will deliver the sofa after the store obtains payment from GE Money Multiservis in its account. The delivery company will subsequently make delivery of your sofa together with the Transfer Protocol which also serves as the Warranty card (the purchased merchandise becomes immediately the property of the Buyer). 3. Warranty
- The warranty for the goods sold is issued pursuant to generally applicable legal regulations that are included in the transfer protocol which serves also as the Warranty card. Unless indicated in the online product catalog at www.centrum-sedacich-souprav.cz otherwise, the warranty period on the goods for all brands is 24 months. The warranty period begins when the Buyer assumes possession of the merchandise.
- The warranty is valid for manufacturing defects or other defects which were not caused by unprofessional or improper handling or maintenance, or using the product in conflict with its intended purpose or use instructions, mechanical damage, wear and tear, natural disasters or other external factors.
- The warranty does not apply to damage that results from normal usage and to mechanical damage. The Seller has the right to refuse a claim for return of goods in cases where the Bill of delivery or transfer protocol has been visibly altered, such as by transcribing it and by similar actions.
- The place where claims for returns or allowances of merchandise may be made is the Seller’s warehouse in Dolní Žďár 74, 363 01, Ostrov nad Ohří, Czech Republic.
4. Returned goods
- In case the Buyer cancels his Order he is obligated to reimburse the Seller expenses incurred in connection with the cancellation. The Seller will claim the right to reimbursement of expenses especially in the case of a purchase of goods that were specially ordered for the Buyer or in the case when demonstrable expenses were incurred in connection to receiving the goods, such as transportation expenses and similar expenses.
5. Goods
- All photos are illustrative. The colors of sofas can differ from reality (particularly due to technical reasons such as computer monitor settings, age of goods, lighting in the room, etc.).
- The Seller reserves the right to sell goods in other shades of color of leather or fabric in response to changes by manufacturer which the Seller cannot influence.
- The allowed tolerance for the actual dimensions of furniture is +-5%.
8. Concluding provisions
- These Terms & Conditions are valid in the scope and version that is found on the Seller’s internet pages at the moment of sending the Order.
- By signing the invoice, the Buyer confirms to the Seller that he accepts the amount of the price for the ordered goods and all Terms & Conditions and other provisions that are valid at the moment of purchase.
- The legal relationship between the Seller and the Buyer is governed by the laws of the Czech Republic and excludes international conflict of laws. The parties agree that the district court in Karlovy Vary, or the regional appellate court in cases where the court establishes the jurisdiction of the regional court, is the relevant court for resolving possible legal conflicts.
- Pursuant to section § 262, par 1 of the Commercial Code, the parties expressly agree that unless the Terms & Conditions expressly provide otherwise, their rights and obligations are governed by the Commercial Code, particularly § 409 and subsequent.
